JD Vance’s crackdown targets PERM sponsorship at eight tech firms—not the H-1B program or green cards already issued.

For foreign tech workers, the distinction is stark: H-1B visas are not being suspended, but a route from temporary work to permanent U.S. residency is now under pressure.

Vice President JD Vance announced Thursday that the government is suspending Microsoft, Adobe and six other technology companies from the Permanent Labor Certification Program, known as PERM. The move affects employer-sponsored green-card applications, not the H-1B visa program itself.

Are H-1B visas being cancelled?

No. The announcement does not suspend the H-1B program or revoke visas workers already hold, according to . H-1B visas let skilled foreign workers take specialized jobs in the United States under temporary nonimmigrant status. They generally last up to three years, though they can be extended.

That means affected workers may still be able to work under an existing H-1B visa. But the new restrictions can make it harder for some to pursue permanent residency through their employers.

What does the PERM suspension change?

PERM is a Labor Department process that often serves as the first step when an employer sponsors a worker for an employment-based green card. To obtain certification, a company generally has to show there are no qualified, willing and available American workers for the position. Employers must advertise the role and document their recruitment efforts.

Vance said the administration is suspending eight technology companies from the program. Labor Secretary Keith Sonderling said the government would not accept new applications or process pending permanent labor certification applications involving those companies, reported.

The order targets the residency side of sponsorship. It does not mean every foreign employee at those companies immediately loses permission to work, and it does not revoke green cards that have already been issued.

Why is the administration targeting tech firms?

The Trump administration has argued that reducing foreign-worker hiring would protect jobs for Americans. Vance pointed to Microsoft’s reported layoff of 6,000 workers, claiming the company had replaced them with foreign workers. That claim was part of his argument for the crackdown, not a finding established by the PERM suspension itself.

The issue has also exposed tensions among Trump allies. Some, including Elon Musk—a South Africa-born former H-1B visa holder—have defended the program as a way for companies to recruit skilled talent from abroad. Others have called for a harder line on immigration and priority for American workers.

For workers whose employers are affected, the immediate change is a barrier to moving from temporary status toward an employer-sponsored green card. The announcement does not cancel H-1B visas, but it leaves that permanent-residency path uncertain while the suspensions are in effect
